Terms of sale and website use
These terms apply when you buy a work from Honeycomb Brands and when you use shop.honeycombbrands.co.uk. Please read them before you place an order. If you're a consumer, nothing in these terms affects your legal rights.
1. About us
This website is run by Honeycomb Brands, 66 Paul Street, London EC2A 4NA. You can contact us at [email protected].
2. Our works
Every painting we sell is an original, one-of-a-kind work, signed by the artist. Because each piece is made by hand in mixed media, its texture, brushwork and finish are part of the work and are not faults.
We photograph each work as accurately as we can, but colours can look different depending on your screen and its settings. The sizes we give are the canvas sizes and are approximate.
3. Orders
You must be 18 or over to place an order. When you place an order you're offering to buy the work. Our contract with you starts when we email you to confirm we've accepted your order. Because each work is one of a kind, if the same work is ordered twice at once, or a work becomes unavailable, we'll tell you and refund anything you've paid in full.
Works are sold for your own personal use and enjoyment, not for resale as a business.
4. Prices and payment
Prices are in pounds sterling (GBP) and include any VAT that applies. Delivery charges are shown before you pay (see delivery and returns). Payment is taken when you place your order and is handled securely by our payment provider.
If we've made an obvious mistake in a price, we'll contact you before accepting your order, and you can choose whether to go ahead at the correct price.
5. Delivery
We'll tell you when your work has been sent. Delivery times are estimates. If something outside our control delays delivery, we'll let you know and keep the delay as short as we can.
Deliveries outside the UK: your order may be charged import duties, customs fees, local VAT or sales taxes and handling charges by the destination country. These are your responsibility unless we tell you otherwise before you pay.
The work belongs to you once we've received full payment. It's our responsibility until it's delivered to you or to someone you've nominated, unless you arrange your own courier.
6. Your right to cancel
If you're a consumer, you can cancel your order for any reason within 14 days of the day you receive the work. Tell us by email at [email protected]. You then have a further 14 days to send the work back. We also offer a longer, goodwill return period; see delivery and returns.
We'll refund the price and the standard delivery charge within 14 days of receiving the work back (or proof that you've sent it), using the same payment method. Unless the work is damaged, faulty or not as described, you pay the cost of returning it, and it must be packed carefully so it arrives undamaged. If the work has been handled more than you'd need to inspect it, we may reduce your refund to reflect any loss in value.
Commissions: if a work is made to your own specification, you can't cancel it once we've started making it, unless it's faulty or not as agreed. We'll confirm in writing when an order is treated as a commission.
7. Damaged or faulty works
Please check your work when it arrives and email us straight away, with photos, if it's damaged, faulty or not as described. Under the Consumer Rights Act 2015 you're entitled to a work that is as described, of satisfactory quality and fit for purpose, and we'll put things right by repair, replacement where possible, or a refund. In that case we'll also cover the cost of returning it.
8. Copyright in the artwork
When you buy an original work, you own the physical artwork. Copyright and all other intellectual property rights in it, including the right to reproduce it as prints, merchandise or images, stay with Honeycomb Brands and/or the artist unless we agree otherwise in writing.
You're welcome to display the work and share photographs of it for personal, non-commercial purposes. You mustn't copy, scan, reproduce, sell copies of, license or otherwise use the work commercially without our written permission.
9. Using this website
Please don't misuse the website. That includes trying to get unauthorised access to it or our systems, introducing viruses or harmful code, using automated tools to copy large parts of it, or using it for anything unlawful. We may suspend access to the site, or part of it, at any time, for example for maintenance.
We (or the people who licence content to us) own the copyright and other rights in this website, including its text, images of the works, design and the Honeycomb logo. You can view and print pages for your own use. You mustn't copy or reuse them for any other purpose without our written permission. Links to other websites are for your information only; we don't control those sites.
10. Our liability
If we break these terms, we're responsible for loss or damage you suffer that is a foreseeable result of our breach. We aren't responsible for loss or damage that isn't foreseeable, or for business losses: works are sold for personal use.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights as a consumer, or for anything else that can't be limited or excluded by law.
11. Law and disputes
These terms are governed by the law of England and Wales, and any disputes will be dealt with by the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you have a complaint, please contact us first; most things can be sorted out quickly by talking.
12. Changes and contact
We may update these terms from time to time. The version on this page when you place your order is the one that applies to it.
